United Therapeutics Gets Legal Win in Patent Litigation Against Liquidia

United Therapeutics notched a legal win in its patent lawsuit against Liquidia as a federal judge denied Liquidia's motion to block a portion of its legal claims.
Liquidia had motioned to strike part of United Therapeutics' argument that relied on the "common ownership exception," a rule in patent law preventing a new patent from being invalidated based on an earlier patent owned by the same entity. Judge Richard Andrews of the U.S. District Court for the District of Delaware on Wednesday denied Liquidia's motion.
Shares of United Therapeutics were up 13% at $541.68 as of midday Wednesday. Liquidia shares fell 25% to $53.22.
